City Solicitor David Gould, Planning Officer called the meeting to order at 7:00P.M. 1.Election of Officers 2019 Mr. Gould opened the floor to nominations for Chair and Vice Chair. Member Durgin nominatedMember Huhnas chairperson of the Planning Board, seconded by Member Bazinet. Member Shaw nominatedMember Kenney, seconded by Member Brush.The Board voted 4 votes in favor of Huhn and 3 in favor of Kenney, so Ken Huhn will serve as Planning Board Chair for 2019. Chair Huhn nominatedMember Durgin for Vice Chair. Member Bazinet seconded the motion. Member Durgin was unanimously voted in as Planning Board Vice Chair for 2019. 73 HARLOW STREET, BANGOR, ME 04401 TELEPHONE: (207) 992-4280 FAX: (207) 945-4447 WWW.BANGORMAINE.GOV 2.Annual Review & Training Assistant City Solicitor PaulNicklas provided an overview of legal considerations for Planning Board members, as well as general guidance on how meetings are conductedand applications should be considered. If a Board member has any questions on procedural or legal matters, they should not hesitate to contact staff. Public Hearing 3.Amending Chapter 165 –Land Development Code, of the Code of the City of Bangor.This amendment would allow the interstate highways to serve as a buffer for marijuana uses. This ordinance amendment would also make a few other minor changes to bring district provisions into conformity with each other. Planning OfficerGould provided background on the proposed ordinance change. Mr. Gould reminded the Board of the recently adopted buffers for marijuana uses from uses such as schools, churches, etc. This ordinance change would limit the extent of those buffers to the edge of a limited access highway, since they act as a major barrier to movement. Vice Chair Durgin inquired about the case where a marijuana use is located at or near an interchange–even with the freeway in between, the usescould stillbe close to each other. Mr. Nicklasresponded that there is a particular scenario where someone wanted to locatea marijuana use in the industrial areasouth of I-395,however,the buffer from the golfcourse prohibitsmuch of this area from being used, even though both sides are very separated from one another. He noted that there are few areas of there city where this would have an impact. No member of the public spoke regarding the matter. No motionwas made on the matter, but Chair Huhn asked for a vote. The Board unanimously voted to recommend the City Council adopt the proposed ordinance change. OTHER BUSINESS 4.Meeting Minutes Meeting minutes from January 3, 2019 were unanimously approved. Meeting adjourned at 7:25P.M.
