ORDERED,
THAT WHEREAS the City Council is desirous of proceeding with
development design and functional design work on a proposed parking
structure to be located adjacent to the overhead pedestrian bridge
and Renduakeag Plaza; and
WHEREAS the City's parking consultant, Rich & Associates,
Inc., has submitted a proposal to provide such services; and
WHEREAS the City Council by passage of Council Order 87-
256 has transferred the sum of $50,000 from the Reserve -Parking
Development (90-2229) fund to a Capital Project Account to provide
the funding necessary for such services;
NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE
CITY OF BANGOR THAT the Interim City Manager, on behalf of the City
of Bangor, is hereby authorized to execute an amendment to the
Agreement between the City of Bangor and Rich & Associates, Inc., a
copy of which is on file in the office of the City Clerk, providing
for development design and functional design work for a proposed
parking structure.
STATEMENT OF FACT: The fee for these services will be billed at an
hourly basis with a not -to -exceed m of
$43,000 which includes approximately $7,000 for
reimbursed expenses incurred by the consultant
n travel, communication, printing and
postage/delivery charges. The professional fee
portion ($36,000) will be credited by the con-
sultant to any fees established for complete
design services if the project continues to the
contract document stage.

THIRD AMENDMENT TO MARCH 1, 1985 AGREEMENT
BETWEEN THE CITY OF BANGOR AND
RICH S ASSOCIATES-, INC.
THIS AMENDMENT to the Agreement of March 1, 1985 is made
this day of , 1987, by and between the CITY OF
BANGORt as municipal corporation located in the County of Penobscot,
State of Maine (hereinafter 'CLIENT" or "CITY'), and RICH AND
ASSOCIATES, INC. with offices at 25240 Lehrer Road, Southfield,
Michigan, (hereinafter 'EA" or "RICH AND ASSOCIATES').
WHEREAS, the City of Bangor entered into an AGREEMENT for pro-
fessional services with Rich 6 Associates Inc., dated March 1, 1985;
and
WHEREAS, ARTICLE A of Said AGREEMENTprovides for City retention
of Rich E Associates, Inc. to provide such additional services as
may mutually be agreed upon by execution of both parties of a
written amendment to said AGREEMENT which to specifies the addi-
tional services to be provided and the fees therefore; and
WHEREAS, by passage of Council order on October , 1987
the City Council of the City of Bangor autliiorized the InterTm City
Manager, on behalf of the CITY, to execute an admendment to the
Agreement between the City and Rich and Associates to provide for
additional services by Rich and Associates; and
WHEREAS, Rich and Associates submitted a proposal to the City of
Bangor dated October 5, 1987 to provide additional services;
NOW THEREFORE, in accordance with Bangor City Council Order
and the proposal submitted by Rich and Associates dated
October 5, 1987, the AGREEMENT made and entered into the 1st day of
March, 1985 by and between the CITY OF BANGOR AND RICH AND
ASSOCIATES is hereby amended:
1. To incorporate the additional services to be provided by
Rich and Associates as contained in the proposal submitted to the
City by cover letter dated October 5, 1987 and attached hereto and
made a part hereof as Exhibit A.
2. The fee for the additional services outlined in Exhibit A
will be billed to the City on an hourly basis in
accordance with the
fee schedule for Rich and Associates and WEBSTER,BALDWIN, RONHAN 6
CZARNIECKI contained in Exhibit A, the total fee .not to exceed a
maximum of $43,000 which includes approximately $7,000 for reim-
bursalfor actual out-of-pocket expenses for travel, communication,
printing, postage and delivery incurred by the RA in providing the
service provided for herein. Theprofessional fee portion of the
fee (the fee less reimbursed expenses) will be credited to City by
RA to any fees established for complete design services beyond the
cope of services provided for herein should the City and Na.. agree
to future additional services to continue to the contract document
stage.
IN WITNESS WHEREOF, this Amendment is hereby approved and agreed
to by both parties hereto in duplicate counterparts as of the day
and year first written above.

Dear Mr. Lord:
Enclosed please find our proposal to provide functional design
work on the proposed parking structure behind the Freese
building. I have also enclosed as a part of the scope a
discussion of our Squatter's Session, which we would utilize in
performance of this contract.
In a previous meeting I specified the goals and objectives for
this work. They are to first look more definitively at the
design of the parking structure with regards to the location,
site survey, and soil conditions. In addition we will also need
to look more extensively at facade treatment and potential
overhead Connections for pedestrians. Finally, traffic should
also be studied and would be of a big concern.
The purpose of a Squatter's Session is to bring in Rich and
Associates design staff to Bangor for a minimum Of 3 days to have
scheduled meetings and discuss initially the programming and then
to have meetings with the City Council and other interested
Individuals concerning the final outcome of the functional
design. Much of this work of schematic or programming has been
done previously by our firm and would not have to be repeated,
but during this next phase, we should review past work. The
purpose of this contract should be to .bring the design of the
proposed parking structure to a point where bids could be taken
on a preferred construction method i.e. precast Or poured -in-
place. There should also he enough drawings completed in this
phase to begin contract documents and complete the same within
approximately 45 to 60 days. We are prepared to begin the design
development phase immediately on this project and would foresee
the total effort taking approximately 5 weeks. -
I have contacted the firm of Webster, Baldwin, Rohman S
Czarnecki to provide Rich and Associates with a very important
Part of this project, which would be coordination of the exterior
facade and urban planning consulting. We understand and fully
appreciate that the project is going to be a highly visible
structure in the downtown. we want to make this project
successful from the functional design and revenue collection

standpoint, as well as from the architectural and aesthetic
standpoint. This facility needs to be compatible with existing
and proposed buildings within the downtown, and more
specifically, the buildings directly adjacent to the parking
structure.
Our work on the design development drawings will be completed to
a stage where construction drawings could be started at any time,
with no overlap or duplication in service or additional money for
restudy or start up.
We look forward to the opportunity to once again work with the
City Council on this project and look to it as an opportunity to
complete a plan that we began acme 3 years ago.

SCOPE OF WORK
CITY OF BANGOR
REVIEW OF PREVIOUSLY COMPLETED SCHEMATIC DESIGN PHASE*
1.1 RA (Rich and Associates) shall review with CLIENT
and/or authorize representative the requirements of
the PROJECT and shall confirm such requirements to
CLIENT.
1.2 RA shall review the site in regard to existing and
future traffic flow points of access and egress,
and pedestrian connections.
1.3 RA shall review schematic drawings completed to
date for vehicular entrances and exits, interior
and exterior ramps, modular arrangement for typical
parking positions within the building, vertical
transportation,preliminary column spacing and
automobile parking layouts.
FUNCTIONAL DESIGN PHASE
1.4 RA shall prepare from the above schematic design
studies, approved and Confirmed by CLIENT, the
functional design drawings incorporating column and
bay spacing, location of vertical transportation
cores, including stairs and elevators, elevations
and grades on parking floors and ramps, ramp
diameters, ramp widths, curbing, location of

drainage, typical lighting pattern each parking
stall, location of parking control equipment, sign
locations and verbiage on signs, location of
cashiering, garage storage areas and washrooms.
1.5 RA shell provide sufficient cross sections and
miscellaneous details to show conditions on typical
floors such as wheel stops, rail details, pipe
guards, bumper stops and column guards.
1.6 RA will review structural systema such as poured-
in-place poet tension or precast and prepare
documents sufficient to construct a cost estimate
and time schedule .for both the completion of
construction documents, bidding and construction.
1.7 RA will prepare structural drawings and
calculations for preliminary pricing on the
structural system.
1.8 RA will prepare outline specifications for the
construction project...
1.9 RA will prepare a color rendering of the proposed'
Parking structure.
1.10 RA will work with Webster, Baldwin, Rohman,
Czarniecki, PA to analyze and select exterior
facade, pedestrian Time and landscaping.
2.0 THE CLIENT'S RESPONSIBILITIES -
2.1 The CLIENT shall provide full information regarding
his requirements for the PROJECT.
2.2 The CLIENT shell designate, when necessary, a
representative authorized to act in hisbehalf with
respect to the PROSECT. The CLIENT or his
representative shall examine documents submitted by
RA and shall render decisions pertaining thereto
promptly to avoid unreasonable delay in the
Progress Of We work.
2.3 The CLIENT shall furnish a certified land survey of
the site giving, as applicable, grades and lines of
streets, alleys, pavements and adjoining property,
rights-of-way, restrictions, boundaries and
contours or spot elevations on a 25' grid,
sidewalk, curb and gutter elevations of the site;
location, dimensions and complete date pertaining
to existing buildings, other improvements and
trees:. and full informationconcerning available
service and utility lines both public and private.
2.4 The services, information, surveys and reports
required by Paragraph 2.3 shall be furnished at the
CLIENT's expense, and RA shall be entitled to rely
upon the accuracy thereof.
2.5 - The CLIENT shall furnish information required of
him as expeditlously as necessary for the Orderly
progress of the NORE.

SQUATTERS SESSION
Because of Rich and Associates' work with clients in many states
across the country (and the World) we have established what we
call a Squatters Session. The Squatters Session Was designed to
bring together all the design professionals both from Rich and
Associates' staff, as wail as from the staff of associate firma
in an intense design session, which produces the schematic design
of the proposed perking facility.
Rich and Associates has used this methodology in the past to
generate cohesive design projects with multi -disciplinary firms.
The benefits Of the Squatters Session are first to bring together
all the design professionals and the Client in an intense
planning session. We feel this Is important because it brings
our staff to the Client office or other separate location, where
we stay throughout the initial design phases. Our design staff
is therefore, away from the phones and other projects within our
Office and are able to concentrate solely on your project for the
period of time we are there.
The second benefit is that during the Squattera Session design
items are reviewed on a constant basis and the City becomes
involved with the design process. The client can therefore
remain as involved as they want depending on the mount of time
they are able to spend assisting in the design process.
There are Set meetings planned throughout this entire phase. On
the first day of Squatters a programming session is held where
information gathered before hand is analyzed and the goals and
Objectives are again reviewed with the Client. Preliminary
schemes are then generated based upon these discussions within
the next couple of days and these sphemes are then presented and
critiqued. Many of the design considerations and concern about
the project are studied and discussed throughout the Squatters
Session. Toward the middle of the Squatters Session we typically
have additional input into the project. This may take the form
Of a community meeting where we ask for the input of citizens,
design review committee etc. on design, traffic, security and
other important items. Our goal is to solicit as much citizen
input as the Client feels is necessary to help promote the
overall project. Because we are planners, we feel that this
input Is Important to the overall SUCCeas of the project.
Finally, based upon schemes that are identified in the session,
the team will prepare hard line drawings that will include ground
floor, typical floor, roof level and elevations. The purpose of
the Squatters Session Is to,. concentrate our efforts on the
project at hand and to limit the back and forth discussions that
are held during a typical design process. we feel that by
concentrating Our efforts in the initial phases a path is set
based upon the goals and objectives of, the City. Decision; are
programmed to be made throughout the process and the City becomes
n Integral part of the design staff. At the end of Squatters e
design report Is completed and sent to the client that reviews
the process, the thoughts that went into the schemes and finally
a reproduction of the schemes that were developed.
