Inc. . — AssistyithNegoUation of Consent Agreement _for, Secondary Sewtgq_Treatment _ By tae qty Council Of 0141 Oft ojBm�or: ORDERED, THAT, WHEREAS, the City of Bangor by City Council Order No. 86-368 passed September 18, 1986 authorised the City Manager to enter into a contract with Woodard 6 Curran, Inc. for consulting services pertaining to the development of secondary sewage treatment facilities; WHEREAS, the scope of services in said contract included assistance. to the City with the negotiation of acent agreement with DEP or EPA 1n the estimated amount of $66,190.OD;and WHEREAS, if is new evident that the negotiation of said consent agreement will be much more extensive than was originally anticipated, primarily asresult of the possible u overriding of pre negotiations between the Cityand the Maine Department of Environmental Protection by the Federal Environmental Protection Agency, the coat of said .negotiations now estimated to overrun by approximately $45,000.00; NOW, THEREFORE, Be It ORDERED, THAT the City Manager be and hereby is authorized to enter Into an Amendment to said contract to increase the amount of Task 2 - As6iet wltp deso[iation of Consent Agreement by Forty-five Thousand Dollars ($45,Oo0.o0), bringing the total estimated fee far Task 2 fo One Hundred Eleven Thousand One Hundred Ninety Dollars ($111,190.00), a copy of said Amendment attached hereto; and be It further ORDERED, THAT the sum of Fifty Thousand Dollars ($50,000.00) be transferred from the Sewer Reserve Account to Account No. 52-60-20 (5244) to cover the coat of said additional work. City Engineer - - City Hall - Bangor, ME 04401 RE: City of Bangor Secondary Treatment Evaluation Continuation of Scope of Service - Task 2 near John: - Please find enclosed the proposedScope of services continua- tion for Task 2 - Assist with Necotiation of Consent Acres- . ment. An estimated fee of $45,000 is proposed for Woodard c Curran, Inc_ to assist the City with continued negotiation of the consent agreement for the time period beginning March B. 1987. Even at this time it is highly speculative as to whether the negotiations with the DEP and EPA will be com- pleted in a timely fashion and whether this adjustment will cover the full cost ofour technical assistance during the entire .process. The total cost of the negotiation process will largely depend on which position the City decides to take on issues such as upfront penalties, stipulated penal- ties and the overall compliance schedule. The requested in- crease of $45,000 brings the total estimated fee for Task 2 to $111,190. Woodard s Curran, Inc. will continue to ivoice the City o a monthly basis, detailing the activities per- formed in the billing period and those activities anticipated in the nexttwo months. ATTACHMENT 3 Scope of Services - Task 2 (Continued) Phase I - - Task 2 - Assist with Negotiation of Consent Agreement (continued) Description This Attachment 3 details a task breakdown and cost estimate for the Company to continue assisting the City with the negotiation of -a consent agreement. It is unknown even at this time what the duration or extent of the negotiations will be and hence, what the duration, extent or total cost of the Company's involvement will be.
