Agreement with Maine State housing Authority—Mocesaa HWan Relations Services St. els on —0nergency shelter program In aced' d f' � f� �weilman Emergency Shelter Grants Program Application LOCAL GOVERNMENT CERIIEICATIONS TO THE MAINE STATE HOUSING AUTHORITY S: Emergency Shelter Grant Application(s) for the following Shelter operator(s): (List sub -grantees) St. Michael's Center Greater Bangor Area Shelter The undersigned Chief Executive of City of Bangor (m micipal£ty) certifies to the Maine State Housing Authority (MBRA) that with respect to all Emergency Shelter Grant Program applications submitted by this local government to MSHA, this local government will ensure the following by means of grant agreements with all sub -grantees; or, if the local government is itself the grantee, it will enter into a grant agreement with MSM to ensure the following. 1) No more than 152 of the total of all grant requests submitted by this local goverment will be expended on the provision of essential services as defined in the Emergency Shelter Grants Application Program Guide, Section III.B. 2) _In the 'case of any application requesting funds cc perform improvements to a building, the building will remain It me as a shelter for not less than three years after the grant award (if the rehab mount constitutes 353 of the pre -rehab value of the building), or not leas than ten years (if the rehab constitutes more than -35% of the pre -rehab value of the building). 3) Requested grant amounts will be obligated to MSM -approved recipients - within 120 days of grant ward announcements. 4) Use of grant fends will comply with non-discrimination and equal opportunity laws including: (a) Nondiscrimination and Equal Opportunity. (1) The requirements of Title VIII of the Civil Rights Act of 1968, 42 U.S.C. 3601-19 and implementing regulations; Executive Order 11063 and implementing regulations at 24 CPR Part 103 and Title vI of the Civil Rights Act of 1964 (42 U.S.C. 2002d-1) and Implementing regulations issued at 24 CPR Part 1; (2) The prohibitions against discrimination on the basin of age under the Age Discrimination Act of 1935 (42 U.S.C. 6101-03) and the prohibitions against discrimination against handicapped individuals under section 504 of the Rehabilitation Act of 1933 (29 U.S.C. 394); (3) The requirements of Executive Order 11246 and the regulations issued under the Order at 41 CPR Chapter 60; and (4) The requirements of section 3 of the Housing and Urban Development Act of 1968, 12 U.S.C. GRANT AGREE!ffilT Emergency Shelter Operator Grants Program 1. This Grant Agreement is made by and between the Maine State pausing Authority (hereinafter referred to as "KSM"), and the City of Bangor (bereinafter referred to as "Recipient'). 2. The grant which is the subject of this Agreement is authorised by Part C of Title p of the United States Department of Rousing and Urban Development's (hereinafter referred to as "HUT') appropriation for fiscal year 1981. Section 101(g) Pub. L. 99-500. The Grant is also subject to M's regulations at 24 CPR Part 575, as now in effect and as may be amended from time to time, which are incorporated as part of this Agreement. 3. MSM hereby allocates Pour Thousand and no/100 Dollars ($4.000.00) in grant funds to Recipient for suballocatiou to D.p.R.S. Saint Michael's Cancer, (hereinafter referred to as "Shelter Operator') for the following approved expenses. Recipient agrees to suballocate all grant fonds allocated order this Agreement by entering into a suballocacion agreement with Shelter Operator by no later than 60 days from the effective date of this EmevShelter Grant 4reement/043087 Page 1 of 6 Agreement. Me suballocation agreement shall be subject to prior review and approval by HSHA. If Recipient fails to enter into the suballocation agreement with Shelter Operator as approved by NSHA within the 60 day period. NSHA may require that some or all of the grant amount be forfeited. 5. After executing the suballocation agreement with Shelter Operator as required in paragraph 4, Recipient any draw dawn the grant funds by submitting written requests to MHA. Fund requests shall Identify Recipient, Shelter Operator, amount of funds requested, how such funds are going to be spent, the timeframe for expenditures, and such other Information as NSHA may reasonably require. In the case of any funds being awarded to perform improvements to a building, NSHA any require that evidence of completion of work accompany the written request for funds. MARA will distribute the grant fonds to Recipient within tea (30) days of the written request. Thereafter, Recipient shall distribute the funds to Shelter Operator within ten (lo) days of receipt from MSHA. 6. Recipient agrees to monitor the expenditure of all grant funds by Shelter Operator in order to ensure that the funds are expended for the purposes and expenses get forth in paragraph 3 within 30 days of distribution of the funds by Recipient to Shelter operator unless otherwise approved by MSHA. Recipient shall certify all expenditures to MHA within 30 days of expenditure. Such certification shall include written documentation of costs such an. receipts and such other EmerShelter Grant Agreement/063087 Page 2 of 6 information as MSRA may reasonably require. If Recipient fails to ensure the expenditure of the funds by Shelter Operator within the 30 day period fallowing the distribution, or to certify expenditures within 30 days following expenditure, MU may require that Recipient reimburse HSHA for some or all of the grant funds. 1. In the case of any fonds being awarded to perform improvements to a building, the Recipient hereby certifies to MRA that it will ensure to MSHA's satisfaction that the building will remain in use as a shelter for not less than three years after the grant award if the cost of rehabilitation constitutes 75% or less of the pre-rebabilitation value of the building, or not lees than ten yearn if the cost of rehabilitation constitutes more than 15% of the pre -rehabilitation value of the building. 8. In the case of any funds being awarded to perform improvements to a building, the Recipient hereby certifies to MRA that it will ensure to MSRA's satisfaction that the building will remain in use as a shelter for not less than three years after the grant award if the cost of rehabilitation constitutes 15% or less of the pre -rehabilitation value of the building, or not lees than ten years If the cost of rehabilitation constitutes more than 75% of the pre-rehabilfration value of the building. 8.
