A new City street, known as Shepherd Drive, was constructed, extending easterly from Pinson Road for a distance of approximately 980 feet, and thence southerly anadditional 290 feet to Puahaw, Road. Said s 0adway M constructed to awidth Of 30 feet, consisting of 3 inches of bituminous c rete pavement on a 6 inch select gravel base and a 12 inch gravel subbase A second v , known s Airedale Place,aconstructed, extending i northerly street direction from Shepherd Drive for a distance of approximately 250 feet. Said roadway was constructed to a width of 22 feet, with a Cul-de-sac at the northerly end, with the same construction standards as were used on Shepherd Drive. A sanitary sewer system, consisting of 2,977 linear feet of 8 inch pipe and 11 manholes was provided, connected to an existing 12 Inch sewer located at approximately 275 feet south from Pashas, Road. 1n additio, 4 inch sewer laterals were provided to each of the 46 Lots served in the Subdivision. A storm sewer system was installed, consisting of 210 feet of 6 inch anderdrain, 371 feet of 12 inch pipe, 348 feet of 15 inch pipe. 295 feet of 18 inch pipe. 286 feet of 21 inch pipe. and 598 feet of 30 inch pipe, and 11 catch Isaias.. "Asphalt coated corrugated metal pipe was used for the storm sewer, which discharges into an existing brook located approximately 250 feet south of Pushaw Road. The total final cost of the project is $224,736.70, broken down as follows: Hughes Bros.. Inc., construction of streets and sewers $168,272.55 Lane Construction Corp., paving Pushaw Road 13.888.42 Lane Construction Corp., paving new streets 24.546.52 Bangor water District relocating existing service line 939.66 -I- design review Total $224,]36.)0 The final cost compares favorably with the original estimate of $224,150.00. Of the above amount, w $10,350.00 was for the 4 inch sewer lateral,, the cast of which istocharged to the Developer, leavinga balance of $214,386.70 as costs eligible for City participation. City Council Order No. 85-307 passed August 26, 1985 provided that the City would participate in the a and s construction costs ata maximum rate of fifty percent,or$307,193.35, which would leave a balance to be paid by the Developer, including the sewer lateral costs, of $117,543.35. A total of 46 Lots are benefitted, amounting to an assessment against each Lot in the amount of$2,555,29. City Council Order No. 85-307 also provided that the a e smars be deferred fox maximumof three years from the City Council's acceptance of the final coat report of the City Engineer, provided: a. That prior to assessment the Developer enters into a written agreement with the City specifying the terms and conditions of said deferred payment; b. That aseach Lot is sold, all street and sewer assessments for said Lot shall be paid; C. That on the first annual anniversary date of said asents, s the Developer shall have paid all such assessments o at least six On the n and annual anniversary dateof said assessments mes the Developer shall have paide all such assessments at least six additional Lots. The pa yna nts received by the City for assessments on Lots sold as provided in Paragraph b. aboveshall be credited to the Developer's liability for payments due on the first and sec and a ual anniversary date,. On the third annual anniversary date of said asencs, the Developer shall pay all remaining unpaid assessments, including interest, is the City, d. That in the event the Developer fails or refuge, to comply with the payment requirements of this Order the City shall have the full right to recover Interest at a annual rate 01 122 from the date that the payment of theassessment r ie due,, plus Its costs, as provided under 23 M.A.S.A. $ 3605 and 30 M.R.S.A. $ 4453, and to otherwise pursue Its remedies as provided by law to collect said assessments. In addition, two-thirds of the cost of paving Puebaw Road by Me Lane Construction Corp. would be paid by the City in accordance with Article 4, Section 2.4 of the Laws and Ordinances, making the City's share to be $9,258.95, and the Developer's share to be $4,629.47. In accordance with City Council Order No. 05-307 passed August 26, 1985, the remaining costs would be shared equally between the City and the Developer. In summary, the breakdown of costs would be as follows.
