Introduced and filed by In City Council February 22,1988 ••.••°+�•^•// Passed C eflman LAWARIMINIrr _ CITY OF BANGOR, RAINS Engineering Department January 25. 1988 To the Municipal Officers: Reference is made to City Council Order No. 86-13, as amended by substitution, passed November 25, 1985, which authorized the construction of the streets and severs in the Hemlock Ridge Subdivision on Burleigh Road, inaccordance with a petition from Harold D. Johnson, the owner and developer of said Subdivision. All work has been completed, consisting of the fallowing: The project included the Construction of approximately 2,400 feet of roadway, consisting of Woodland Drive extending in a southerly, thence easterly and northerly direction for a distance of approximately 1,700 feet, and Westwood Road extending in an easterly direction from Woodland Drive to its terminus. The roads were constructed to a width of 24 feet, with 1 1/2 inches of bituminous concrete payment on an 16 inch sand and gravel subbase, and 'select gravel base course. All graded areas outside of the paved limits were provided with 4 inches of loam act seed. A sterni sewer system was constructed consisting of 767 feet of 6 inch underdrain and 1,939 feet of pipe ranging in sive from 10 inch to 30 inch, 13 catch basins, 1,400 feet of open ditch, and a are= water retention pond. A sanitary sewer system was installed which included 2,130 feet of 8 inch pipe and 9 manholes, with 4 inch service laterals to each of the 29 lots within the Subdivision. The total coat of the project, including construction. contract administration and inspection, was $226,255.38, which compares favorably with the original estimate of $261.800.00. The final cat includes An Allowance of $18.750.00 for the future application of an additional 1 1/2 inches of surface pavement, to be applied when most of the adjacent lots e developed, and anallowance of $1.600.00 for street lights to be installed by the City at such time as they are needed. In accordance with Council Order 86-13 a ended, and Council Resolve 85-294 as ended and passed August 261985. the City would participate inthe street and sewer construction coat at a maximum rate of fifty percent of the total of said cost, with the exception of sanitary Sewer laterals to each lot and street lighting, the costs 0f which are to be paid by thedeveloper. A breakdown of the total project costa is as follows: There are a total of 29 lots within the Subdivision, so that the assessment per lot would amount of $4,039.00. In accordance e ordance with Council Resolve 85-294, the assessments will be deferred for a maximum of three years from the. date of City Council acceptance of the final coat report of the City Engineer, provided that: 1. Prior to a sment the Developer will enter Into a written Agreement with the City specifying the terms and conditions of said deferred payment. 2. As each lot Is sold the assessment for that lot shall be paid. 3. On the first annual anniversary date of said assessments the Developer shall have paid the total assessment o at least six lots, with a total of at least six more lot assessments ents to be paid at the end of the second anniversary, and the entire balance to be paid at the end of the third anniversary. 4. That interest at an annual rate of ten percent shall accrue and become a part of said assessments from the date of assessment to the dates of the payment, said interest to. be billed annually to coincide with the above-mentioned anniversary dates. 5. Upon any failure to comply with the payment requirements. the City will recover t Interest a annual rate of twelve percent from the due date, plus costs, and to otherwise pursue its remedies as provided by lav to collect the assessments. It is recommended that the assessments be levied under the conditions outlined aboveC� Plans showing the actual construction are on file in the Office of the City Engineer.
