THAT the zoning boundary, lines as established by the. Zoning Map of
the City of Bangor dated September 23,_1974, as amended be hereby
further amended as follows:
By changing a parcel of land located at304 Hancock Street (Tax Map
No. 55, Parcel No. 26) from Industrial 2 Zone and Residential 5 Zone
to Commercial 2 Zone. Said parcel containing approximately 1.87 acres
and being more particularly indicated on the map attached hereto and
made a part hereof.
PROVIDED HOWEVER, THAT, in addition to the mandatory conditions imposed
by Chapter VIII, Article 21, Section. 11.3, Ordinances of the City of
Bangor, said change of zone is granted subject to the following con-
ditions:
1. The use and/or operation of the subject premises shall be
subject to the following limitations and/or restrictions:
b. The propertywill be used for professional and business
offices; provided, however, that the basement floor of
the. Viner Building presently located on the property may
be used for limited neighborhood commercial uses upon
the following terms and conditions:
1) Said neighborhood commercial

only on the bottom floor of the existing structure,
the so-called Viner Building,. located on the
property:
2) The total floor area occupied by said neighborhood
commercial uses shall not exceed 10,000 square feet
of the bottom floor of said Viner Building;
3) For the purposes of this zone change application,
the term "neighborhood commercial uses' shall be
limited to small service businesses and retail
stores primarily serving the surrounding neighborhood,
including, abut not limited to, the following:

and the surrounding neighborhood, which uses shall
be limited to the following:
(a) grocery store, subject to paragraph 1., a., 5),
below
(b)drug store
(c) self-service Laundromat
(d)' laundry pick-up station
(e)' barber shoe/beauty parlor
(f) shoe repair shop
(g)- a florist'sshop, selling flowers at retail
(h) a store selling office supplies at retail
(i) a store selling arts and crafts supplies at retail
(j) a store selling greeting cards and novelties
at retail
(k) book store
(1) a store selling kitchen accessories and house-
wares at retail
(m) a store providing document reproduction services
at retail, including, but not limited to,a
store providing photocopy services, but not
including a business operating an industrial
printing press
(n)a store selling antiques at retail
(0) travel agency
(p)'a store servicing and selling electronic office
equipment at retail
(q) a store selling clothing and apparel at retail
5) the term "neighborhood commercial uses" shall not
include restaurants, taverns, or other food setvice
facilities which prepare and/or serve food on the
premises or sell foods prepared on premises for con-
sumption on or off the premises.
2.' Execution by those parties with an interest in the affected
property of an agreement providing for the imp lamentation and enforce-
ment of all the terms and conditions set forth above and the recording
of said executed agreement in the Penobscot County Registry of Deeds
by the property owner, a copy of said agreement being on file in the
Office of the City Clerk and incorporated herein by reference. In the
event that said agreement is not so executed and recorded within ninety
(90) days from the date of passage hereof, this Ordinance shall become
null and void.

THAT the zoning boundary lines as established by the Zoning Map of
the City of Bangor dated September 23, 1974, as amended be hereby
-further amended as follows:
By changing a parcel of land located at 304 Hancock Street (Tax Map
No. 55, Parcel No. 26) from Industrial 2 Zone to Commercial 2 Zone.
Said parcel containing approximately 1.7 acres and being more par-
ticularly indicated on the map attached hereto and made a part
hereof.
PROVIDED HOWEVER, THAT, in addition to the mandatory conditions imposed
by Chapter VIII, Article 21, Section 11.3, Ordinances of the City of
Bangor, said change of zone is granted subject to the following condi-
tions:
1. The use and/or operation of the subject premises shall be
subject to the following limitations and/or restrictions:

a floor area exceeding,: 3,600 -square -feet:
3)the total floor area occupied by all of said neigh-
borhood commercial uses shall not exceed ten thousand
(10,000) square feet of the bottom door of said Vince
Building;
4) for the purposes of this zone chane application, the
term "neighborhood commercial uses shall be limited

Please be advised that the Planning Board at its regularly
scheduled meeting on February 16, 1988, held a continued public
hearing on the above request. -
After careful consideration of the area, and the proposed
contract conditions, the Planning Board voted three in favor and
..opposed to recommend approval to the City Council of C.O. S
88e93(As Amended). A copy of C.O. 988-93(Amended) 1s attached.

Action for a coning change will be initiated with the Bangor City Council end
referred to the Bodnar Planning Board. Statutes require a Public Hearing before the
Planning Board, after a public advertising (at least 10 days prior to such public
hearing), for all changes to the Boning ordinance of the City of Bangor. The

omoendation of the Planning Board is then returned to the Bangor City Council for
final action.

hearing for the above contract zone change request at its regularly
scheduled meeting of February 1, 1988.
At the request of the applicant, the Planning Board voted
five in favor and none opposed to continue this public hearing
to the Board's next-meetin on February 16, 1988 to allow for
additional time to amend the proposed contract conditions.
