The Planning Board held a public hearing on the above subdivision plan at
its meeting of August 21, 1989:
James BuFonr, Had., representing the applicant, spoke in favor of the final
subdivision plan, He noted that a proposed agreement between the City and the
applicant had been submitted to the City Solicitor's Office for review and
approval. -
Gerald Deechaine, an abutting property comer, spoke in oppositica. He explained
that he was in negotiation with the applicant regarding the possible relocation
Of the proposed roadway in order for hdm to carry out proposed development
plans on his lot.
John Lair, a Parkview Avenue resident, expressed his concern with adding
development and additional traffic on Stillwater Avenue.
The Planning Board voted 5 to 0 in favor of a motion to approve the final
subdivision plan with the condition that the proposed agreement regarding
maintenance of the private roadway be approved by the City Soldtor

at 323V Stillwater Avwue - The Willows Subdivision, during been reviewed by the
Flawing Begird and found to be in genecal conformance with local subdivision laws
and State of Maine Statutes, Title 30, Section 4456, be approved. No public improve-
ments are .proposed, therefore, no bond required.
AND BE IT FURTHER ORDERED THAT., the City Manager be hereby authorized to
statute a Road Agreement between the City of Bangor end Sheldon I. Hartstwe,
a copy, of which being on file in the City Clerk's Office.

In accordance with Chapter NII, Article 6, Section 1.3 of the Subdivision
Ordinance the following processing fees will be Charged:
Minor Subdivision (fewer than 5 lots and no public sewer and no
Public street construction) . $40.00
Major Subdivision (5 lots or more or public sewer or public street
construction ) $50.00 plus $10.00 per lot over 4
lots and $5.00 per lot over 9 lots.

a. This itea was continued from the Board's previous meeting to
allow the applicant and City Staff to revise and review the
plans.
b. As indicated at the last Planning Board meeting the appli-
cant has amended their plan since their initial submit-
tal ,(also an this agenda for site plan approval). The Plan-
ning Staff had recommended that applicant acquire sunJivi-
sion approval prior to site plan approval because the devel-
opment requires the City's approval of the proposed "private
street'. At the Board's duly 5, 1989 meeting the preliminary
plans were approved with the concept of a private street.
C. The final subdivision plans are the documents which are
signed and recorded in the registry of deeds. The City's
subdivision Ordinance requires that the developer of a pri-
vate street provide documentation to the City Solicitor's
office which will cover the construction and future mainte-
nance.
The concept was that some party (possibly a Homeown-
sassociation) would be legally responsible for the upkeep
of the private road and that in no instance would the City
of Bangor be under any obligation to take over such mainte-
nance and upkeep.
d. At the ties of this memorandum no documentation Has been
submitted to the City Solicitor's office. The Planning Staff
would recommend that this be prepared and reviewed by the
legal office prior to approval.
