Planning Division Commentary: . The Planning Board held a publichearing on the above -noted zone change at its regularly scheduled meeting of July 17, 1989. No one spoke either in favor of or in opposition to the .proposed Eons change. THAT the zoning boundary lines as established by the Zoning Map of the City of Bangor dated September 23, 1974, as amended, be hereby further amended as follows: By changing parts of Parcels of land located on Outer Broadway (rax Map No. R-31, Part of Parcel No. 26, and Tax Map No. R-39, Part of Parcel No. 1)from Residential 5 Zone to Residential 1 Zone. This zone change has been initiated by the City to tleal with the presence Oi Residential 5 Zoning in the undeveloped or developing aeof the City as in the recently adopted change in the Stillwater Rvenuell-95 Hreac Much of this area is in a stormwater detention pond as part of the overall development of the Judson Heights area and would not, under present plans, be usable for building "development. However, there is a a that i outside of the limits of the stormwater tletention area which abuts the fisting Residential 1 zoning and could be used for R-5 development. Discussions with the property owner have indicated that a possible z change from R-1 to R-3 with some ontract'canditions might allow for more flexibility for u of this particular area, while eliminating the Residential 5 densities. Such s change would have to be vitiated after the zone change contained in this order i order for the contractconditions to be effective with the mandatory reversionary option contained in the contract under which ethe sCity can initiate a change to the prior zoning if the contract conditions are not met. (In this wouldif the present order were passed the "previous zoning" then be R-1). In. Staff would recommend that the Planning Board recommend this zone change to the City Council.
