Me purpose of this Order is to permit the acquisition of the necessary
Easements for the Eeadowbrook Sewer project.
Efforts are being made to acquire voluntary sewer Easement -Agreements from

all of the property own and this Order will permit the eminent domain
acquisition if voluntary efforts are not successful.

THAT . WSPI S, the City of Bangor is required under a Consent Decree
with the Main Department of Environmental Protection to undertake the
separation and rehabilitation of a portion Of the s dalled dieadowbrock
Sever, extending from Stillwater Avenue near Interstate 1-95 to 5enduekeag
Stream; and
WHEREAS, said Meadovbrook Sewer Project will require the installation of
a new sanitary sever line crossing various properties located along the proposed
route; and
WHEREAS, public exigency requires Immediate acquisition of sewer Easements
to permit the Installation and future maintenance of the nee sewer,
NOW. THEREFORE, Be It
ORDERED, THAT the City Engineer, acting for and on behalf of the Municipal
Officers according to law, be and hereby is authorized to lay out and establish
easements for the proposed Meadowbrook- Sanitary Sever, the location of which is
generally described as follows:
Beginning at the Eauduekeag Stream Interceptor Sever located on the easterly
side of Renduskeag Stream at Harlow Court; thence extending in a generally north-
easterly direction to Harlow Street, northerly on Harlow Street to the inter-
action of Renduskeeg Avenue, easterly along the general route of the existing
Meadowbrook Sewer to Market Street at the intersection Of South Park Street:
then northeasterly along South Park Street to Center Street, and reorienting
along South Park Street to the intersection of French Street; thence in anorth-
easterly direction across Broadway Park t0 the intersection of Stillwater Avenue
and Pine Street; thence northerly om, the Street and northeasterly to Essex Street'
thence northerly on Essex Street end easterly to Grove Street; thence northerly on
Grove Street to Milford Street; thence northeasterly along the southeastetly.side
of the so-called Bicycle Poch t0 Interstate Highway I-95 t0 a point near the
northeasterly -line of the James Taylor Hospital property; thence in a southerly
direction to Stillwater Avenue: and thence in 8 ortheagtgr1p,4 ecctlon along
Stillwater Avenue t0 a point located approximately the hundred (200) feet northeast
OE Howard Street; also Included is a branch connection extending from Harlow Street

The purpose of said easements is to permit the City of Bangor o
its agents to enter upon the above described properties as necessary to
Install and maintain a sanitary s within the easement areas,
including clearing, grubbin. sewer
grading. Roaming And seeding. Me purpose
of the proposed sewer 1s to separate a much sanitary flow as passible
from the existing combined Meadowbroak Sewer system, so
as to divert as
m om
much of the storwater as possible frthe interceptor sewer and
treatment system.
There met at the time and place of the meeting Mrs. Barbara B.
Fames, the owner of the property at 56-58 Stillwater Avenue. She
objected to the proposed location of the sewer
across her property,
since she felt that it would prevent any future expansion of the
existing building. After examining the location proposed, it was
determined that an alteration in the alignment could be made to keep
the sewer further to the rear of her property, and the modified location
Is described above. Mrs. Karnes had no abjection to the proposed modified
location or the damages recommended.
Since the sewer
easements a needed Immediately to permit the
completion of the sewer installation prior to December 31. 1989, a
required by the Maine Department of Environmental Protection Consent
Decree, it is recommended that the easements be laid out and established
as noted above, and that the recommended damages be paid.

The purpose of said easements is to permit the City of Bangor or
its agents to enter upon theabove described properties as necessary to
install add maintain 'a sanitary s within the easement areas,
including clearing, grubbing, grading, and seeding. The purpose
of the proposed sewer
s
separate a much sanitary flow as possible
from the existing combined MeadovbrookSew system, so
art
o dive as
much of the storm water as possible from the interceptor sewer and
treatment system.
There net at the time and place of the meeting Mrs. Barbara R.
Karnes, the owner of the property at 56-58 Stillwater Avenue. She
objected to the proposed location of the sewer
across her property,
since she felt that 1t would prevent any future expansion of the
existing building. After examining the location proposed, it was
determined that a alteration in the alignment could be made to keep
the sewer further to the rear of her property, and the .modified location
s described above. Mrs. Karnes had no abjection to the proposed .modified
location or the damages recommended.
Since the sewer
easements s deeded immediately to permit the
completion of the sewer installation prior to December 31, 1989,
required by the Maine Department of Environmental Protection Consent
Deares, 1t is recommended that the easements be laid out and established
as noted above, and that the recommended damages be paid.
