Commentary:
The Planning Board, at its regularly scheduled meeting of
December 19, 1988, held a public hearing on the above subdivision
application.
Mr. Darrell Cooper, the applicant, spoke in favor of the final
plan. No one spoke in opposition.
The Board voted 5 to 0 in favor of a motion to approve the
final subdivision plan with a recommendation for a waiver of
bond.

Item No. 11 Site Plan Revision - 614 Broadway - Grant Trailer
Sales, applicant
a. Applicant requests an extension of the completion date for
the construction of anaddition to the existing building lo-
cated at 614 Broadway in a C-2 Zone.
It. The site plan was approved by the Planning Board on duly 18,
lTaa with a completion date of November 30, 1988. Applicant
is now
requesting an extension of that date to July 20,
1989.
C. As the requested data falls within the two-year time provi-
sion, from the date of approval, for completion of site
plans (Article 21, Section 10(0), Staff would recommend
site plan revision approval.
PUBIC HEARINGS
Item No, 21 Contract Zone Change - Blake Place - Sheldon Hart -
stone - C.D. # 89-27.
a. Applicant requests a contract zone change for approximately
33,000 sq. ft. of land located Off Market Street. The zone
change requested is from Residential 4 Zone to Residential 3
Zone.
b. At the time of this memorandum, applicant does not have
standing to bring this application. Staff would recommend
the Planning Board continue this item to the first meeting
in January or until such time as the applicant acquires the
necessary legal interest.

a. Applicant requests final subdivision plan approval for a
13 -lot subdivision located off Musson Avenue in a Rapidan -
tial 4 Zone. The proposed subdivision is located behind the
existing Morningside condominium project.

b. This prodect received preliminary plan approval on September
-19, 1908 with the condition that the City Engineer approve
the storm drainage plan. The City Engineer has reviewed a
revised store drainage plan which meets with his approval.
c. The proposed subdivision involves one street, Fieldstone
Drive, which serves the thirteen lots. All lots will be
served by public water and sewer utilities.
d. Staff would recommend final plan approval an the condition
that the applicant post bond, o, some other form of guaran-
tee for the public improvements

a. Applicant requests a zone change from Residential 5 Zone to
Residential 3 Zone for approximately four acres
of land a
LaSalle Drive. The property in question is presently before
the Board far site plan approval of several multi -family
buildings.
b. The present zoning at this location has been in place since
1973- Prior to 1973 this -a coned agricultural. On
May 30, 1973, the City Council rezoned this area to Resi-
dence A, Residence C, And ,general Business. (See attached
Map.) When the 1974 Zoning Ordinance was adopted the zones
were
converted to R-19 A-5, and C-3. The 1979 Land Use Plan
revision identified those areas as low density residential,
high density residantial, and commercial, consistent with
the zoning and intended uses.
C. The main problem that Staff has with the zoning an LaSalle

(That is, that R-4 zoning, for a ample, would be consistent

ate to zone the site R-3 has several facets to it: some of
these have legal implications and same are simply normal
planning and zoning concerns
s such as what is appropriate at
this point in time in thislocation. We will defer legal
concerns to others at other times as we feel that it i
appropriate for the City Solicitor's Office to comment on
any questions that arise in this regard, (Also, many legal
concerns which are raised in argumentation before the
Planning Board are beyond the scope and the ability of the
Board to deal with as wall.)

It is my understanding that the city has decided to implement its
policy regarding the bonding of the construction of proposed public
streets. I will be appearing before the Planning Board on Monday
for a subdivision off Hanson Avenue, with a proposed road to be
accepted by the city. I certainly ds not have any problem in the
city's concept regarding bonding, and it is certainly much more
lenient than ➢ion's, and my question to you is whether or not if
the contractor provided a Payment and Performance Band could I assign
it to the city of Bangor?
After you have had an opportunity to reflect on this. would you be kind
enough to let me know your thoughts.
