The Planning Board held a second public hearing on the above
contract zone change request at its regular meeting on Nay
21, 1990.
Attorney Paul Rudman, Sidney Epstein and Douglas Brown evoke
in favor of the zone change. Also, Gerald Thompson, a Bangor
House resident presented a petition from Bangor House residents.
to support of the zone change.
Cordon Rulberg, a Fourth Street resident,spoke in opposition to
the requested change.
After considerable discussion about the parking needs of the
site and the continued viability of the Shop 'N Save supermarket
at this location, the Board voted 4 to 1 to recommend the contract
zone change with minor changes in the proposed conditions to the
City Council.

Said part of a parcel containing approximately 19,906 eq. ft. and being

PROVIDED, HOITZER, THAT, in addition to the mandatory conditions imposed by

In the event that said agreement is not so executed and recorded within ninety (90)
days from the date of passage hereof, this Ordinance shall become null and void.

a. lifter the Planning Board voted to reend denial of this
change request, it went beforetheCouncil for
final action, where it was tabled. At the request of appli-
cant the item was tabled at a second meeting when additional
information was promised to the Council to assist in its
decision. At that time the Council was advised that if
significant evidence were to be introduced by the applicant
at the Council meeting, the Council Alight decide that it
would be appropriate for that. information (which was not
heard by the Planning Board) to be heard in order to give
the Planning Board benefit of all the information submitted
and an opportunity to comment on .the additional information
for the benefit of the Council.
b. Therefore, when applicant produced a study on parking done
by Deluca Hoffman Associates, aonsulting engineering firm,
the Council referred the item back to the Planning Board
with this additional information, for its review. To make
certain that this Information would be part of the record on
this application, we advertised the zone change again to
ndicate that there would be a rehearing at the Board's May
7th meeting, Therefore, it is appropriate to open the pub-
lic hearing �a'nd ask for additional information in relation-
ship to -this application. (The Planning Board need not hear
pregyO�,y 4ly submitted information, unless it so chooses.)
C. The Wformation in question relates to a turnover study of
the parking lot done on two different dates by consultant
Deluca Hoffman Associates. The findings of this effort are
attached to this memo
and indicate that from their observe-
tiaOf the Site, the parking lot was nearly full at times

that during utilization periods of the year such as at
Christmas time, parking lot "cannot a modate demand."

ort of "out lot" from the C-2 complex located at Fourth
Street, Union Street and Third Streets (the location of
Doug's Shop IN Save and Wellby Drug buildingsl.
b. The proposed zone change would square off the parcel in
question and would provide Additionalparking to the site
only. (One of the conditions permits the use for "parking
accessory to the building located at 220 Union Street.")

C. The Shop IN Sava site is indicated for commercial use
n the
City's Land Use Plan and the proposed expansion for parking
would involve only an additional 19,000 sq. ft. of land
area. While the existing .parking meets minimum standards
for off-street parking in the Zoning Ordinance, it is not
adequate for the type of high -turnover use presently on the
site, which leads to pressure ion on -street parking In adja-
cent residential areasand congestion within the parking let
areas and around curbcutlocations on the site. The aodi-
tional parking can only be viewed as an improvement to the
functioning of the site and as a potential relief from
off-site vehicle congestion generated by the existing site
development.
d. Given the land use policy : commercial An this site and

zoning, Staff would recommend that the contract zone change
request be recommended to the City Council.

Dear Mr. Collins:
Far your request, we have completed a parking study of the Doug's
Shop N' Save store at the intersection of Ind and "ion Streets
in Bangor, Maine. The purpose of our study was to determine the
average and peak period occupancy rates for the shopping center
which consists of a 2S,000 square foot shop N'Save and 0,000
square foot weYlby Drug store.
DELUCa-Hoffman Associates, Inc. recorded the parking spaces which
wereoccupiedevery IS minutes in the shopping center during the
following times:

The results Of the study are presented in Table 1 of the Appendix
to this letter for the shopping center. This table shows the
maximum spaced occupied during any of the iS minute intervals as
follows:

Based upon the results of this study and our observations,
DeLuca-Hoffman Associates, Inc. recommends the new parking lot be
constructed for the following reasons:
o The above data indicates that at peak times the shopping
Center parking lot becomes nearly full. These observations
were made in March and it is likely that during peak
periods of the year such as Christmas, the parking lot
cannot accommodate the demand. '
d The existing layout of the parking lot is not ideal for a
grocery store. The circulation pattern and stall widths
are restrictive. once the lot is approximately 60%
occupied (116 spaces occupied out of 145) traffic
circulation within the lot becomes difficult, and from an
operational standpoint the lot is nearly full.,
c The employees of the center presently park in the sppaces
adjacent to Union Street. If the employees parked in the
new lot, this would open up more spaces en the existing let
to.the general public.

I am writing to request that consideration of Ordinance 90-90:
Amending Zoning Ordinance Fourth Street (Unfinished Business) be
continued until the next regular Council meeting on April 23, 1990.
When this Ordinance was continued at the last meeting (March 26)
1 was told it would be brought up at the next regular meeting on the
second Monday of the month and I was planning on attending. Only
yesterday did I learn that the meeting was scheduled for Wednesday,
April 11, 1990. Unfortunately, I am unable to attend this Wednesday.
Therefore,I respectfully request that the Ordinance be continued.
