HomeMy WebLinkAbout1991-09-23 91-359 ORDERDate 9-23-91 Item No. 91-359 Item/Subject: Authorizing City Treasurer to Set Off Funds Due Against Delinquent Tax Payment Responsible Department: Legal Com emery: Title 36 M.R.S.A. g 905 allows a municipal treasurer or disbursing officer, subject to approval of the municipal officers, to set off any amounts payable by the municipality against unpaid property taxes owed by the party to whom the payment is due. This Order would formally authorize the City Treasurer to apply such setoffs. In the case of City employees, the Order would exclude from setoff an amount equal to 759 of the emplgyee's disposable weekly earnings r 40 times the Federal minimum hourly wage, whichever is greater. The Order also would act apply to any individual whose taxes had been deferred under the State's senior citizen tax deferral program or other provisions of law. An example of the persons affected by this Order would be a delinquent taxpayer to whom the City owes rent. (®rb¢r, Authorizing City Treasurer to Set Off Funds One Against Delinquent Tax Payment BY W Cay CoeuB of Ad O&V ofBeesor: ORDRRRD, MT the City Treasurer of the City of Bangor is hereby authorized and directed with respect to any amounts of money now or hereafter due and payable by the City of Bangor to any City taxpayer, to set off against such amounts due any real or personal property taxes owed by such taxpayer to the City of Bangor, together with interest and costa, remaining unpaid more than thirty (30) days beyond the date on which such taxes were originally due. This authorization is given pursuant to 36 B.R.S.A. S 905. This Order shall not apply to any amount payable by the City of Bangor to an employee as salary in excess of the maximum _ garnishment amounts provided in 14 N.R.S.A, 5 3127 Thin Order also shall not apply to any unpaid property tax, payment of which has been deferred in accordance with 36 B.R.S.A. 5 6250 or other provision of law.
