SUBJECT: Bangor, Union Street Overlay, Project ID 60.10
Dear Mr. Ring
This is in response to your August 14, 1991 letter to Robert M.
Phillips, Assistant Director, Bureau of Project Development,
regarding the above noted project. We share the City's desire
to complete the work this Summer.
The contract specifications you sent earlier this month have
been reviewed and are
acceptable to a We agree with the work
and estimated costs yououtlined iT your August 14, 1991 letter
and hereby authorize the City to proceed with this work under
your contract with Lane Construction Corporation and subject to
the following terms and conditions
1. The City shall notify the Department in writing of all
proposed and actual project beginning and completion
dates.
2. The Department shall be allowed to inspect all
construction activities as
necessary to ensure compliance
with the approved plans and specifications.
3. The City shall be responsible for all of its engineering
and overhead costa expended on the project. None of such
costs shall be eligible for reimbursement by the
Department.
4. The Department shall be responsible for all of its

The City shall not be required to participate in such
costs.

5. The Department shall reimburse the City for the cost to
construct the projects, exclusive of all engineering and
overhead costs and the cost to adjust space
manholes, at

the rate of 87.5% i an amount not, to exceed $100,625
($115,000 x 87.5°%)
6. The Department may also reimburse the City far such
additional costs as may be hereafter agreed to in writing
as the result of any extra work or changes requested or
approved by the Department.
7. Reimbursement shall be based upon actual payments made to
the contractor orexpenditures for work completed. The
Department shall be allowed access to the City's
financial and construction records to verify such
payments or expenditures.
a. All invoices r bills presented by the City to the
Department for reimbursement shall contain a
itemization of all work completed. The Department's
pr -rata share towards the cost of such .cork shall be
shown separately thereon.
b. The City shall forward to the Department within three
(3) months from the date of project completion a
itemized final bill or statement for seep project eo
completed showing all work accomplished thereunder.
C. All correspondence, statements and billing requests
regarding reimbursement hereunder shall be directed to
the Department's Bureau of Project Development, ATTN:
Office of the Chief Engineer.
S. The City shall allow the Department to audit all of the
City's project records for these projects.
You will notice ine
item 5 above that we have increased your
estimate of total project cost to $115,000. Thisw s done to
establish -a ceiling for State cost, whit.- adding some reasonable
contingency amount to the effort.
Please be in touch with John E. Hodgkins, Engineer of
Construction, (telephone 289-2171) with regard to your
construction schedule so that he cametre any necessary
assignment of personnel to inspect the work for the Department.
I have passed on to him documents and copies of project
correspondence noted earlier.

We will assume, unless we hear otherwise, that the City agrees
with the terns and conditions listed above and will be
proceeding soon with this work. Thank you for your help
