Commentary: The purpose of this order is to authorize the execution of
an agreement with Bangor Water District for the extension of a water
main n Milk Street east of North Hildreth Street. This extension is
part of the previously approved development agreement with Grant's
Dairy. Length of the water line is 380 feat and Cost of the project
is $10,665.

TEAT the City Manager is hereby authorized and directed,
n behalf of the City of Bangor, to execute an agreement with
the Bangor Water District, a copy of which is on file in the
office of the City Clerk, providing for the construction of
water line extension from the end of the existing water
main on Bildreth Street easterly on Milk Street for a distance
of approximately 380 feet.

WHEREAS, the utility is engaged Sr. the business of supplying
servicewater the public in the City of Bangor and several other

WHEREAS, the applicant has recounted that the utility's water
malm be extended :o service property owned by the customer On the
corner of North Hildreth Street and a yet unnamed street immediately
north of Grants DI ry-Bullding in Bangor NE , a distance of approximately
380 feet from the end of the existing water main on Hildreth Street.
NOW THEREFORE, 1`. is agreed between the customer and the utility
as follows:
The developer agrees to pay the utility 610,663, which As

that this fall amount will be paid by May 1, 1991 .2
2. The developer agrees that payment shall be made according
to the following schedule:
a. The developer agrees to deposit the amount of 610,663 with
the utility on May 1. 1991 0 which represents 100 percent of the
cost of materials mai supplies and detailed engineering.
b. The developer agrees to pay 6 NA, which As the remainder
of .the total amount required by paragraph 1, by NA.4

4. The utility agrees to furnish all pipe, fittings, pumps,
controls, structures, equipment, and whatever labor Is required to

in accordance with the District's policy thereon, free of encumbrances,

beyond the extension and to serve other mains, or to tap and take
off from the extension laterally. Further or lateral extensions shall

10. This contract Is subject to the rules of The State of Maine
Public Utilities Commission governing water main extensions (65-407
Clde. 65), which are here'oy Incorporated by reference into this contract.
In the event of a conflict between this contract and the Commission's
water main extension ar
rules, the rule shall govern. The pties understand
that the provisions of
this contract. are subject 'o alteration by
a decision or rule of The Public Utilities Commission'
11. Disputes arising under this contract or under the Public
Utilities Commission water main extension rule may be referred pursuant
to that rule to the Commission for resolution.
