THAT
Edward A.Harrett, City Manager, is hereby
authorixed to execute a Quitclaim Deed conveying the City's
interest in a property on Hancock Street, described on Tax Map 55,
Lot 181, to William J. and Janice L. Dearing as joint tenants.
This conveyance is to be subject to the City
retaining an appropriate easement for its sewer line and upon the
payment of $2,500.00 by the Deerings to the City. The to= of the
deed must be acceptable to the City Solicitor.

RE: Sale of City Owned Property

William and Janice Deering, who live at 423 Hancock Street,
have expressed an interest in acquiring a City owned lot on Hancock
Street which is located between two lots that Janice currently owns
n Hancock Street. A copy of their offer letter and assessing
information has been distributed as part of the agenda packet. The
Bearings have been using this lot for parking, with the City's
consent, for a number of years. The lot is unbuildable both from a
zoning standpoint, as well as topography.
The most crucial issue is that the Pearl Street sewer line
runs through the property to the Penobscot Interceptor. They have
agreed to a sewer easement that will prohibit the building of any
structures and require them to pay for any restoration after any
work the City does on its sewer line. Further, they have offered
to pay the assessed value of $2500 for the property. A copy of my
letter to the Deerings, which explains the mechanics of the
conveyance, is attached.
Staff have been contacted and there has been no opposition
expressed. This conveyance will add a small parcel to the City's
tax rolls. Staff recommends approval subject to the execution of
proper documents approved by the City Solicitor -

Dear Or. and Ms. Deering:
mhamc you for your letter of March 22, 1993 concerning, your
interest in the above -referenced City -owned lot. As I have told
you, your offer will be presented to the Finance Committee at its
next meeting on April 7, 1993 at 7:30 a.m.
I will recommend acceptance of the offer. Should the
Committee vote to accept the offer, an Order will be placed on the
agenda of the April 12th City Council meeting (7t30 p.m.) to
authorize the City Manager to execute a quitclaim deed conveying
the property to both of you as joint tenants.
The joint tenancy is necessary to avoid a situation where twat
or in this case, three, contiguous nonconforming lots are in common
ownership. If that were to happen, the City would treat all three
lots as one lot. At that point a future division (selling the
'green house") would not be allowed absent a variance or contract
zone change (to allow the multi -family unit to remain in aingle
family zone). City staff would be opposed to those options•
On the other hand, by purchasing this lot in joint tenancy you
can sell the "green house" with its existing configuration or with
a sliver of the joint tenancy and not affect your currently
existing lot. Once the "green house" is disposed of to your
satisfaction, you could then take steps to place the joint tenancy
in Ms. Deering's name to merge it with your currently existing lot.
The City's quitclaim conveyance will reserve a sewer easement
that will prohibit the building of any structures on the lot. You
will also be required to pay for any site restoration, including
repaving should you pave the parking spots, should the City need to
access the sewer line for whatever reason.

The width of the easement may have to be as much as fifty feet
(501) depending on the depth and actual location of the sewer
line. Your connection of the 'green house" to the sewer line will
assist Bangor in determining haw wide the easement must be to
protect the City. You should work closely with the Engineering
Department and the sewer line staff when you are ready to proceed
with that connection•
It would assist me in preparing the deed if you could send me
copies of the most recent deeds for 423 Hancock Street and the
'green house." I'll do the necessary title work on the Bangor lot
to come up with a deed description we can both be happy with. -

Dear Mr. Shibles,
Thankyou very much for taking the time and for giving of your k ledge in
helping us work towards developing a stable basis for our use of the City
owned lot located between our two properties at 405 and 423 Hancock Street.
The need to convect the house at 405 Hancock Street to the City's sewer syatam
caused the clarification of our use of this sixty-six fast (66') lot of
land to he timely.
mise Lillian Snith of the assessors office nest helpfully provided us an
aessmant of the value of the lot of which we write, Int 181 of map 55.
Enclosed is a copy of that assessment estimating. the value of the lot to be
two thousand five hundred dollars ($2,500.00).
We mould like to offer to purchase that lot at its assessed value Of
two thousand five hundred dollars ($2,500.00). we understand that the
assessed value is based on a 1008 valuation formular.
