The attached Order would authorize sale of a 22' x 100' strip of
land off of a lot owned by the City on West Broad Street (Tax Map
15, Lot 122 - see sketch attached). The sale has been requested by
Coldwell Banker/American Heritage Real estate on behalf of Fannie
Mac Mortgage Corporation, which iscurrently marketing the adjacent
property at 347 Buck Street. The purpose of the request is to cure
an fisting driveway a achment on the City's adjacent lot. The
purchase price, $4,000.00 has been determined based on the City's

The City Manager is hereby authorized to sell a
portion of the city -owned lot designated as Tax Map 15, Lot 122, to
Fannie Mac Mortgage Corporation Or its designee, as an addition to
the property located at 349 Buck Street, designated as Tax map 15,
Lot 123. The land to be sold consists of a strip fronting 22 feet
n Buck Street and extending 100 feet back from Front Street
adjacent to .the present northwesterly line of 347 Buck Street. The
selling price shall be not less than $4,000.00, with conveyance to
be by municipal quitclaim deed in a foam approved by the City
Solicitor.

The Registry entry in question provides license tocontinue the
encroachment by the a of the subject property on the City of
Bangor park property shown as map A 15, Lot S 122
Caldwell Banker American Heritage Corp. acting as agents for
Freddie Mae, an agency of the Government of the United States of
America, herein requests the City of Bangor to Consider action to
convert the aforementioned License to a permanent easement or to
establish terms by which the portion of the lot describe in map f
-15, Lot M 122r be conveyed by Fee Simple Ablsolute to the owners
of the subject property.
CBAHRE requests that a statement of anticipated costs be provided

RE: Request to Purchase City -owned Land
(Tax Map 15, Lot 122 - portion)
Recently, i have been contacted by Paul Savoie of Coldwell
Banker, on behalf of the Freddie Mac mortgage corporation, to
request that the City convert a recorded encroachment license
granted to the prior own of 349 Buck Street into a permanent
easement or fee conveyances- Copies of the correspondence, license,
and a sketch based on the City's tax map are attached.
I have looked at the City's source deed, dated July 12,
1944, which conveyed the land concerned from the Roman Catholic
Bishop of Portland to the City of Bangor. Apparently, the City's
lot had formerly been held by the Bishop with the intention of
using it for cemetery purposes. However, there are no restrictions
on future use or disposition in the deed from the Bishop to the
City. 11
At your convenience, please take a look at this request and
let me know if there are any reasons why the City shouldn't sell
its underlying fee interest in the encroachment area to Freddie Mac
at fair market value. i have scheduled this item for discussion by
the Finance Committee on April 3, 1995, and would appreciate your
comments by that date.
By copy of this memo, i have asked Ben Birch to develop a
figure for the land value of the adjacent residential lot (Map 15,
Lot 123), on a per square foot basis.

Problem, encroachment on city property by above address;
On March 30, 1995, a rough maent of the property at 347
a
Buck Street (map 15, lot 1231 w conducted by the Assessing
Department. using a 150' tape, the amount of encroachment o
lot 122 has been determined to be 22' minimum.
Measuring the depth of the lot 100', it would appear that a
strip of land 22' on Buck Street and 100' deep be considered
the least amount of land to be conveyed by the City.
Based on the current front -foot value of the neighborhood
under consideration the value per front foot is $175.20.
This figure times the 22 feet is $0,854.00, rounded to
$4,000.00 value,
