Summary The proposed zone change will amend the zoning at 10 Alden Street. The applicant, Bangor Broadway, LLC seeks to locate a building closer to the street than the S&PS District will allow. The applicant is proposing a contract Downtown Development District to enable moving the building closer to the Right of Way line. The other contract conditions will limit other development aspects similar to that of the S&PS District. WHEREAS, the zoning boundary lines as established by the Zoning Map of the City of Bangor dated October 28, 1991, as amended, be hereby further amended as follows: By changing two parcels of land located on Alden Street (Tax Map No. 37, Parcels 94, and 94A Shopping and Personal Service District to contract Downtown Development District. Said parcels containing approximately 1 acre each and being more particularly indicated on the map attached hereto and made a part hereof. HIM 18-012 NOVEMBER 13, 2017 9mmum an I'l NSI � � T E R S-Tj ATE'9 5 1s-012 NOVEMBER 13, 2017 The applicant has applied for a Contract Zone Change under the provision of the Land Development Code — Section 165-7 and proposes the following conditions: The use and/or operation of the subject premises shall be subject to the following limitations and/or restrictions: A. The lot area of the Property shall be at least 1/2 acre. B. The Property shall meet the parking requirements of Sections 165-71 and 165-72 of the Bangor Land Development Code. C. The height of any building on the Property shall be limited to 50 feet (which is not more than 25% above the S&PS dimensional height limit of 40 feet). D. The impervious surface ration shall not exceed 0.6 (or 60%). E. The proposed project will provide for pedestrian sidewalk connections to existing and/or proposed sidewalks. F. The maximum lot coverage for the Property shall not exceed 30%. G. The minimum lot width for the Property shall be 100 feet. H. The proposed building on the Property will utilize one or more of the following design techniques to address the building entry mass and bulk: a. Entry design to suggest pedestrian access into the building from Broadway. b. Varied roof lines with either sloping or pitched roofs. c. Use of landscaping elements along Broadway and Alden Street (specifically, 2-3 street trees along Broadway and 4 street trees along Alden Street) to support the subdivision of the building fagade into smaller scaled sections. Gould, Planning Officer SUBJECT:Amending Zoning Ordinance 10 Alden Street –Shopping and Personal Service District (S&PS)to contract Downtown Development District(DDD) –CouncilOrdinance 18-012 Please be advised that the Planning Board at its meeting on November 21,2017, held a Public Hearing on the above zone change request. ViceChairman Charles Boothby asked the applicant or their representative to make a briefpresentation of the request. Mr.Andrew Hamilton, Esq. of Eaton Peabody indicatedthat he was representing Bangor Broadway, LLC. Attorney Hamilton introduced Michael Coffman head of Bangor Broadway,LLC. Mr. Hamilton reviewedthe details of the Comprehensive Plan and the rezoning application’s consistency with the Plan. He noted much of Broadway is developed commercially. He also noted many of the same uses in DDD are in S&PS. There were no opponents to the rezoning request. Planning Officer Gould indicated that the request was to rezoneapproximately one acrefrom Shopping and Personal Service District (S&PS) toDowntown Development District (DDD)with contract conditions. Mr. Gould reviewedthe City’s land use policy in the area reflecting Commercial Development. The ZoningPolicyis Shoppingand Personal Service Zoning. What the applicant has proposed is a contract Downtown Development District to enable them to move the building closer to the right of way and then add back the development standardsof the S&PS District through contract conditions. Member Durgin asked about access to the site. Sean Thies, PE of CES indicated that Alden Street would be right in, right out, Broadway will have a full access driveway. City Engineer John Theriault noted there is a new island in Broadway to keep cars from making left hand turns on Alden Street. The site before the Board will have their driveway on the northerly end of the property. Member Durgin made a motion to recommend theCity Council adopt C.O. # 18-012, amendingthe Zoning at 10 Alden Street from Shopping and Personal Service District to contract Downtown Development District,Bangor Broadway, LLCapplicant. Member Hicksseconded the motion and the Board voted unanimously in favor to recommend C. O. #18-012.
