Heller, Finance Director, in executing and delivering a Municipal Release Dead releasing the City's interest in real estate located at 143 Third Street in Bangor to Myra B. Burgess, James E. Burgess, Sr. and Mary T. Burgess, is hereby ratified and affirmed. A copy of said Municipal Release Deed is attached to this Resolve, and is incorporated herein by reference. Stumpfel, City Solicitor RE: it under Suspension of the Rules In July, 1994 the City of Bangor recorded three sr liens against property of Myta B. Burgess, JamesE. Burgess, Sr., and Mary T. Burgess, located at 143 Third Street. The total amount of delinquent sewer rates and interest secured by all three liens was $361.48. Lien costa and recording fees of $93.89 were added to this amount. Additional interest has accrued since July, 1994. The statutory redemption period for these three sewer liens expired 18 months after recording, on January 26, 1996. Concurrently, the owners of 143 Third Street negotiated a sale of the property, scheduled'fox closing later this week. In connection with the scheduled sale, the Burgesses have made a tender of payment of the delinquent sewer amounts (plus lien charges and Interest), together with delinquent IF 1995 and FY 1996 real estate taxes (first half), totalling some $2,015.93 as of February 26, 1996, to be paid from the sellers' proceeds at closing. Because the City's general practice has been to allow late redemptions of tax and sewer lien-foreclosetl residential properties upon payment in full of all delinquent City accounts, where there are no other issues outstanding, (e.g. uncorrected City code or ordinance violations), City Finance Director Ron Heller has accepted the Burgesses' sewer payment and has executed a municipal quitclaim deed for delivery to the Burgesses upon payment of the delinquent real estate tax amounts. The attached Council Order would ratify this action by the Finance Director. It is offered under suspension of the rules to facilitate the Burgesses' previously scheduled real estate closing. Under the Council's current practice, suspension of the rules to consider non -agenda items requires an affirmative two-thirds vote (6 votes). E. .S B. red Attachments
