Commentary:
The structure, located at 66 Curve Street, and owned by Robert
Seger, was placarded a unfit for human u and habitation o
December12, 1991. The building has continued to deteriorate over
the past four years and, in the opinion of staff meets the statutory
requirements for condemnation as a dangerous building by virtue of
dilapidation, structural instability, obsolescence and fire hazard.
Mr. Seger presently resides at Cedar Falls Mobile Home Park in
Bangor.

THAT WHEREAS, the Bangor City Council, in its capacity as
the Municipal Officers of the City of Bangor, held a public
hearing pursuant to 17 M.R.S.A. 92851-1859 to determine whether
or not the structure located at 66 Curve Street, Bangor, Maine,
on a lot described in a deed recorded in Volumes 2156, Page
275, Volume 2170, Page 51, and Volume 4801, Page 361, Penobscot
County Registry of Deeds, owned by Robert Seger, of Bangor,
Maine, constitutes a dangerous building within the meaning of
said statute; and '
WHEREAS, based upon the evidence presented at said
:public hearing, the Bangor City Council finds that the building
or structure in question is structurally unsafe; unstable; a
fire hazard; unsuitable or improper for the use or the
occupancy as a residence; a hazard to health or safety because
of inadequate maintenance, dilapidation, obsolescence or
abandonment, and dangerous to the life and property of the
inhabitants of the City of Bangor; and
WHEREAS, the Bangor City Council hereby adjudges said
building or structure to be a nuisance and dangerous, as
provided in Title 17 M.R.S.A. 92851-2859,
HOW THEREFORE, by the City Council of the City of
Banger;
ORDER®, THAT said building or structure shall be
disposed of as follows:
(1). Said building or structure shall be demolished by the
owners, within thirty (30) days of the date of passage
of this Order, said demolition or removal be performed
in conformity with the Laws and ordinances of the City
of Bangor; and
(2) In the event said structure is not demolished or
rentoved. within thirty (30) days as provided above, the
City's Code Enforcement Officer may cause
said
building or structure to be demolished or removed, all

expenses incurred thereby to be paid by the owner(s)
oassessed against the property in accordance with 17
RrR.S.A. 52853: and
(3) The ownsr(s) of said structure Shall remove
all
personal property located therein. In the event that
the owner(s) fail to comply with this order, the
City's Code Enforcement Officer may remove and dispose
of Said personal property.
and be it further
ORDERED, That the City Solicitor, or his
representative, is hereby authorized to take any and all
additional necessary action to secure the demolition or removal
of said structure.

of the City of Bangor will hold a public hearing to determine if
the above captioned structure meets the requirements set forth

The hearing will be part of the regular meeting of the City
Council held on February 12. 1996 at 7:30 p.m. in the third

Chapter Y, sections PM-lDS.3 and PR -108.1 of the laws and Ordinances
of the City of Bangor (Property Maintenance Code).
You are hereby ORDERED to vacate the above-described premises on or
before December 12, 1991. you are further ordered to give notice to my

OCCUPANCY OR ON pursuant to Chapter X. Section PM -108.1 of the Laws
and Ordinances of the City of Bangor (Propery Maintenance Code).
You, as an occupant of the placarded premises, are hereby ORDERED TO

Dear Mr. Seger
Periodically, as part of our regular Code enforcement Division
activities, we lack at buildings which have been vacant for extended
periods of time to determine if they meet the State's statutory
requirements as a dangerous building by being dilapidated, obsolete,
structurally unsound and/or a fire hazard.
The above captioned building, owned by you, is believed by the City
to be a dangerous structure.
At your earliest convenience we would like to schedule an inspection
by City staff to fully evaluate the condition of the building. The results
of this inspection will determine if the structure will be brought before
the City Council for condemnation and demolition.
I respectfully request you contact me at your earliest convenience to
set up a mutually convenient time for an inspection of the subject
property.

at your Curve Susan property.
Following up on that inspection, I'd like to schedule a meeting with you, at a mutually
convenient time but, as soon as possible, to discuss our findings. Also, at the same time, I will
make arrangements for you to speak with Ron Heller, Bangor's Finance Director, and Norm.

Code's obligations, relative to dangerous buildings, fits in with the property taxes, sewer bills and
the agreement you entered into with the City to come current on overdue payments to the
municipality.

Memorandum
In response to you memo also dated today, the following are my observations and comments on
the above referenced properties. 1 will try to keep my comments relevant and useful within the
context of the old premix "Every property is rebabable". Rehabilitation should always have two
considemmem, l ) Conshuctiom or the technical and snuclOtal feasibility of the project; and 2.)
Financing, or the ability of the owner to repay the loan, and the lender's security for a mortgage
(available equity after rehab). With that said, here goes:
66 Curve Street:
I mored this property with the owner about four or five years ago. He bad been refected to me
for a rehab loan. At that time, the property could have been rehabbed, but it was a close call, it
was in very poor condition. I knew it would take a lot of money, and the after-rebab value in this
neighborhood VaWd not be high, and being as the owner planned on living in it I inquired about
his income and existing mortgages. There was a$40,000+/- existing mortgage on the property
from a local Credit Union. The owner told me that mortgage was in the process of foreclosure,
but the Credit Union would "talk" to my lender interested in financing the rehab. I called the
Credit Union, they were interested in possibly suspending the foreclosure, but were not willing to
subordinate their mortgage. With the potential of $35,000 of rehab costs added to the $0,000
mortgage, (the after rehab value would have to be in the $85,000+ range, not typical in this
neighborhood) and a borrower with a poor credit history, this was obviously not a good loan. I
told the owner and he understood. This was a classic care of technical feasibility (five years
ago), but no finmrdal feasibility based on equity.
51 Seventh Street:
I have never been in this property, but have heard numerous reports from people who have. The
owner of this property also approached me for a rehab loan about a year ago. We sat down in my
once and went over the figures. He told me at that time there are no existing mortgages on the
property. The owner was unemployed, and due m injuries mrd disabilities could be considered
unemployable. His income was limited to, according to him, about $300-$400 per month. I
went through all of his after -rehab expenses with him one by one (loan payment to City, taxes,
insurance, heat, electricity, food ea.) and Nese expenses added up to his entire (unverifiable)
income. Rwasclewto him thathecould notaffordaloan and living expenses, he leftmy office

In response to you memo also dated today, the following are my observations and comments on
the above referenced properties. 1 will try to keep my comments relevant and useful within the
context of the old premix "Every property is rebabable". Rehabilitation should always have two
considemmem, l ) Conshuctiom or the technical and snuclOtal feasibility of the project; and 2.)
Financing, or the ability of the owner to repay the loan, and the lender's security for a mortgage
(available equity after rehab). With that said, here goes:
66 Curve Street:
I mored this property with the owner about four or five years ago. He bad been refected to me
for a rehab loan. At that time, the property could have been rehabbed, but it was a close call, it
was in very poor condition. I knew it would take a lot of money, and the after-rebab value in this
neighborhood VaWd not be high, and being as the owner planned on living in it I inquired about
his income and existing mortgages. There was a$40,000+/- existing mortgage on the property
from a local Credit Union. The owner told me that mortgage was in the process of foreclosure,
but the Credit Union would "talk" to my lender interested in financing the rehab. I called the
Credit Union, they were interested in possibly suspending the foreclosure, but were not willing to
subordinate their mortgage. With the potential of $35,000 of rehab costs added to the $0,000
mortgage, (the after rehab value would have to be in the $85,000+ range, not typical in this
neighborhood) and a borrower with a poor credit history, this was obviously not a good loan. I
told the owner and he understood. This was a classic care of technical feasibility (five years
ago), but no finmrdal feasibility based on equity.
51 Seventh Street:
I have never been in this property, but have heard numerous reports from people who have. The
owner of this property also approached me for a rehab loan about a year ago. We sat down in my
once and went over the figures. He told me at that time there are no existing mortgages on the
property. The owner was unemployed, and due m injuries mrd disabilities could be considered
unemployable. His income was limited to, according to him, about $300-$400 per month. I
went through all of his after -rehab expenses with him one by one (loan payment to City, taxes,
insurance, heat, electricity, food ea.) and Nese expenses added up to his entire (unverifiable)
income. Rwasclewto him thathecould notaffordaloan and living expenses, he leftmy office
with Net understanding. I later found out that there was indeed a mortgage on the property

which would have pushed his monthly expenses way over his monthly income. I didn't go much
deeper into this projecp but my sense is that this is a case of technical feasibility (although this is
disputed by those who have actually seen the inside of the property), and even financial
feasibility relative to the fact 0w equity is good, (this is a very good neighborhood, and after -
rehab value would be high), but, the owner's credit, used ability to pay the large loan amount
prohibited the loan from being made. It sounds to me that the only way to rehabilitate this
property would be ifa moderate to upper income family (not eligible for the CD loan program)
could purchase it for next to nothing, with dear title (almost impassible), and do $50,000 worth
of rehab, it might be financially feasible to rehabilitate this property. However, those are some
majorobstacles.
58 Parker Street
I want through this property with the owner (a woman) well over 10 years ago. At that time 1
told the owner that Ne condition of the property was such that it was not relishable. Technically
speaking the work required was so extensive that it would he cheaper to demolish it and build a
new house. New construction is not permitted by HUD under Ne Residential Rehabilitation
Loan Program. ]hat was over ten years ago. The property has not been touched since. This is
obviously a lost cause.

In accordance with your recent request, I have performed an exterior inspection of the
above -referenced properties Each ofthese exhibited obvious structural defects from the
outside, and I am certain interior inspections would reveal further problems. At such time
that you ere able m gain access to these build'mgs, I or a member of my staff would be
available to provide further assistance.
Based on my, exterior mspecdom, I offer the following relative to the structural condition
of each building:

This is a two story wood Game structure that appears to have been added on to at least
throe times. The main structure is primarily supportd on a concrete block and rubble
foundation. Deterioration hes resulted in noticeable settlement of the two front comers.
The southeasterly foundation wall is creaked and bowed as well. The rear addition(s)
appear to be held up by some type of wood supporting structure with some exposed
rotten members. The rear walls and mof planes are severely distorted from settlement and
lack of support The exterim siding and trim is in very poor condition allowing entry of
water at various locations, which will hasten further deterioration of this structure.
51 Seventh St
The main building is a lenge old two story wood Game structure with an attached all. The
main portion is supported by an exposed concrete block foundation. The whole structme
is out of plumb, and distorted roof and walls (particularly on the northerly side) suggest
that interior support is falling or insufficient. The rear oil is even more distorted and
appears to be approacldng a state of instability. Structural displacement is further
evidenced by misaligned door and window operdngs. The budding is covered with asphalt
siding and a century of roofing materials in poor condition. Numerous openings allow
water to enter the structure. A smell garage is also located on the property, and appears
to be on the verge of collapse.
58 parker Street

This is a 1'h story wood frame structure both upon a foundation conatructed of what
appears to be small broken granite or cobblestone and menu. Much of the foundation
that is visible bas failed and contributes little support to the structure. Given the
foundation condition, 1 am srryrised that this building is still standing. The cldnmey,
located in the northerly half of the building is very deteriorated and severely out of plumb,
which indicates considerable building movement. Fxterior siding is crude wood
clapboards which were installed over asphalt or asbestos siding. Much siding and trim bas
either fallen off or opened up, creating many voids for entry of the elements. Daylight can
be seen through the was at numerous locations.

This memo is a response an you request to the Fite Department for am concerns
concerning the potential for fire at this structure and the danger ro neighboring
properties. This building is currently vacant and placarded following a fire several
years ago. Our biggest concent would be vandals gaining entry and summit a fire at
this armature. As you lmow, this has been a problem in Bangor in the past. A fire at
this building could pose aserious threat to adjacent residences. One neighboring
earromme is within ten feet of the placarded building.
In addition, fires in placarded vacant buildings may be more hazardous to
firefighters than other types of structures due to damage caused by vandals inside the
structure.
