of the City of Bangor dated October 28, 1991, as amended, be
hereby further amended as follows:
By changing a part of a parcel of land located at 915 Union
Street (Tax Map No. R-24, Part of Parcel No. 6) from High Density
Residential District and Urban Residence 1 District to General
Commercial and Service District. Said part of a parcel
containing approximately .35 acres and being more particularly
indicated on the map attached hereto and made a part hereof.

PUBLIC HEARINGS
Nam No 2: Zone Change -915 Union .Street- Eastern Maine Healthcare -C.O.#
97-195.
A. General Description. Applicant Eastern Maine Healthcare has requested a
zone change along the southeasterly boundary of the former Westgate Mall
property (in -town sideline) to extend the cammercial zoning (GC & S) to cover
residentially zoned areas which have historically been used as part of the parking
and circulation for this site development(presently zoned High Density
Residential and Urban Residence 1). The parcel to be rezoned is a long, narrow
"pie shaped" piece which starts approximately 125 feet back from Union Street
and runs to the rear property line of the Westgate site and includes only
approximately .35 acres in area. There will remain a parcel under Eastern Maine
Healthcare ownership approximately 80 feet wide and 190+ feet long at the rear
of the site standing multi -family housing developments easterly from the
Westgate Mall building complex which will still be zoned HDR. (Applicant will
explain that some of the area which Westgate Mall used was on an easement
from abutting property owcers on the Union Street frontage of the parcel which
has now been transferred in fee simple to Eastern Maine Healthcare's property.)
B. land Use and Zoning Policy. The City's Land Use Policy for this area is for
commercial use and the GC & S zoning of the existing parcel is appropriate. The
purpose of the zone change is really only to straighten out a gap in the zoning
between the zone boundary and the property line.
C. Urban Sau o s. The site has a full range of urban services available to it and
is, therefore, within the City's Primary Service Area,
D. Existing Conditions. The majority of the Westgate Mall site is presently zoned
GC & S and much of the land area in the "pie shaped" zone change is presently
paved and used for parking and circulation in conjunction with the former
Westgate Mall use. (In effect little will change in terms of the existing use of the
site development after the correcting zone change is adopted.)
E. Decision Criteria. The threshold requirement for zoning is its consistency with
the City's Comprehensive Plan. The Comprehensive Plan calls for commercial
zoning in this area and this request is really only for a "Gadfication° of zoning
along the southeasterly property line. The retention of the HDR portion of the lot
to the rear in Mat zone protects the existing residential multi -family units in that
area from any encroachment by the Eastem Maine Healthcare's site
