Gould John Theriault Paul Nicklas Chairman Kenney called the meetingto order at 7:00p.m. In the absence of memberWilliams, Chair Kenney noted Member LeBlanc would be voting. PUBLIC HEARINGS Item No. 1:Conditional Use/Site Development Plan review –1240 Hammond Street Glidden Auto Body, Inc., applicant. Chairman Kenney opened the Public Hearing on theConditional Use and asked the applicant or their representative to make a brief presentation. Mr. Fred Marshall indicated he was representing Glidden Auto Body. The proposal was to add a 1,200 square foot addition to secure cars as they await review by auto insurance adjusters. Mr. Marshall reviewed the history of the site originally approved as an auto repair facility on September 21, 1999, expanded6,000 square feetin 2003,and 1,344square feetin December 2007.Some additional gravel area was placed behind the building after the 2007 approval. Chair Kenney was concerned that the amountof disturbance and new impervious may trigger a State Stormwater Permit. Mr. Marshallindicated based on their calculations it was under the threshold. 2 The Board discussed Bangor’s Ordinance requirements and State Permitting. The Board concluded the designers should verify with theState that no permit is required. Member Boothby moved to approve the Conditional Use and Site Development Planwith the condition that the applicant verify that no Stormwater Permit is required. The Board voted five in favor and one opposed to approve Conditional Use and Site Development Plan Review for Glidden Auto Body at 1240 Hammond Street in a General Commercial and Service District, with the condition that the applicant verify that no Stormwater Permit is required. ItemNo. 2:ZONE CHANGE –1612 Ohio Street, Beacon of Hope Church of God, applicant. C.O. #17-057 Chairman Kenney opened the Public Hearing on the rezoning request and asked the applicant or their representative to make a brief presentation. Mr. David Plunkett indicated that he represented the Beacon of Hope Church of God, requesting the property be rezoned to Government and Institutional Service District. The church currently operates a food pantry from the basement of the church and hopesto expand it slightly to provide some more space. They will utilize existing parking and no other expansions are envisioned at this time. There were no other proponents or opponents to the rezoning request. Planning Officer Gould indicated that the request was to rezone approximately 4 acres of land off Ohio Street and Davis Road which was recently acquired by the Church. The existing structure has quite a history at this location. The zoning of the land and its somewhat odd configuration stems from its prior design intent to be single family housing. Some years ago Pastor Bean had inquired about the potential to expand the church at this location. The direction was that if the church could access utility servicesthen G&ISD would be a reasonable request. There was less encouragement for a church located in a rural area to grow substantially, as such a facility should be in a location with access to a large array of City Services. In this instance the surrounding residential development extended sewer, water,and sidewalksto this portion of Ohio Street. Chair Kenney noted G&ISD would allow other uses beyond a church. Member Boothby made a motion to recommend the City Council adopt C.O. #17-057, amending the Zoning of 1612 Ohio Street from Rural Residence and Agricultural District and Low Density Residential District to Government and Institutional Service District. Member McCarthy seconded the motion and the Board voted unanimously in favor to recommend the City Council pass C.O. #17-057. 3 Item No. 3:Zoning Amendment –Land Development Code Process Changes –City of Bangor, applicant. C. O. #17-055 To Amend Chapter 165, Land Development Code of the City of Bangor by Making Procedural Changes in processing of applications; pertaining to Sections: 6, 9, 10, 13, 25, 32, 33, 110, 111, 112, 113, 116, 119, 120, 125, 126, 127, 128, 130, 131, and 133. These changes are designed to clarify Code requirements, reflect current practices, add best practices, and provide additional flexibility for developers where appropriate. Chair Kenney opened the Public Hearing and Assistant City Solicitor Paul Nicklas provided the Board with an update on changes made since the last time this was reviewed by the Board.The amendment makes numerous changes in the land Development Code updating several sections and eliminating some less than useful language from 1991. The amendment includes language to recognize the Development Coordinator as a sole point of contact for permit applications. There were no other proponents or opponents to the proposed text amendment. There was some discussion surrounding whether the Ordinance implied business days or calendar days. Solicitor Nicklas noted that unless stated it implied calendar days,which is throughout the Code. Member Boothby made a motion to recommend C.O. #17-055 be adopted by the City Council.Member McCarthy seconded the Motion and the Board voted six in favor and one opposed to recommend C.O. #17-055 be adopted by the City Council. APPROVAL OF MINUTES Item No. 4:PLANNING BOARD APPROVAL OFMINUTES. The Board continued the Minutes to the next regular meeting. There being no further items before the Board the meeting adjourned at 7:54 pm.
