PUBLIC HEARINGS
1) Porch Setbacks – To amend Chapter 165, Land Development Code of
the City of Bangor, By Decreasing the Setback Requirements for Open
Porches to ten feet in Urban Residence Districts 1 and 2. City of
Bangor, Applicant – C.O. #017-082. CONTINUED From February 21,
2017 Meeting
Chair Kenney opened the Public Hearing and Assistant City Solicitor Paul Nicklas
provided the Board with an overview of the proposed amendment. The intent is to
provide some flexibility to existing residences which may be at, or near, the front yard
setback. The amendment will allow them to construct an open porch on the front of
their dwelling within ten feet of the front property line.
There were no other proponents or opponents to the proposed text amendment.
Member Durgin asked how the front setback was determined. Assistant City Solicitor
Nicklas noted it would be in the deed or shown on a subdivision plan.
Chairman Kenney wondered if the language might be construed to limit the roof to 42
inches above the floor. Mr. Nicklas noted that if it became an issue it could be
corrected.

Member Boothby made a motion to recommend that C.O. #17-82 be adopted by the
City Council. Member Durgin seconded the motion and the Board voted unanimously to
send a positive recommendation to the City Council.
2) Day Care – To amend Chapter 165 – 13 Definitions, 165 – 72 Parking,
165 – 88 to 105 various districts. City of Bangor, Applicant – C.O.
#017-096.
Chair Kenney opened the Public Hearing and Assistant City Solicitor Paul Nicklas
provided the Board with an overview of the proposed amendment. The intent is to align
the City’s Day Care guidelines with the State regulations.
Mr. Paul Bolin of 14 Chestnut Trail spoke in favor of the proposed amendment. He
noted that City Staff was very helpful in resolving the discrepancies between the City’s
Code and the State’s Day Care regulations.
Member Boothby made a motion to recommend that C.O. #17-96 be adopted by the
City Council. Member Durgin seconded the motion and the Board voted unanimously to
send a positive recommendation to the City Council.
3) Waterfront Development District Setbacks – To Amend Chapter 165,
Land Development Code of the City of Bangor, By Eliminating the
Setback Requirements from Railroad Rights of way in the Waterfront
Development District. City of Bangor, Applicant
Planner Gould noted that this was advertised by still in the works. To avoid advertising
the hearing should be opened and continued.
Chairman Kenney Opened the Public Hearing
Member Durgin moved to continue the Public Hearing. Member Boothby seconded and
the Board voted unanimously to continue the Public Hearing.
4) Review and Discussion of Draft Annual Report
Planner Gould noted that this was a Draft of the Planning Board actions in 2016. He
noted he wanted the Board to see it and make any comments on content organization
or other prior to it being forward on to the City Council.
Chair Kenney noted this should be continued to allow members to review it.

5) Planning Board Approval of Minutes
Member LeBlanc moved to approve the Minutes of February 7, 2017 as written.
Member Boothby seconded the motion and the Board voted unanimously to
approve the Minutes of February 7, 2017.
With no other items on the Agenda the Board adjourned the meeting at 7:22.
