Committee convened at approximately 5:00 p.m.
Regular Agenda
1. Comprehensive Planning Committee Membership
Paul Nicklas stated that members of the Special Committee on Comprehensive
Planning were selected by the Council and various City Committees and
Commissions in 2008. The terms of those selected were beginning to run out, so
they would no longer be on the Committee or Commission they were selected to
represent. The Council Order creating the Special Committee did not clearly
indicate whether the same person should remain on the Special Committee or a
new representative should be selected. The proposed Order would be that the
member shall remain on the Special Committee unless the organization that
selected that member chose to appoint a different representative to the Special
Committee in their place. Councilor Wheeler moved and seconded by Councilor
Blanchette.
There was some discussion of the sunset date of December 31, 2010 and a plan
to be presented to the Planning Board for consideration. If the Committee
wasn’t done with their tasks and make a recommendation as to the
establishment of a permanent committee or not they could request an extension
of term.
2. Referral: Amending Chapter 165, Land Development Code, of the Code of the
City of Bangor by Expanding Exemptions for Auxiliary Public Utility Structures
Jim Ring stated this was a referral from the Council and would be considered by
the Planning Board later in the evening.
The current Code was established in the 1980’s and was for typical structures at
that time. The proposed changes came about due to a necessary expansion of

existing auxiliary public utility structure serving the sewage pumping station on
the Perry Road. The proposed changes would increase the allowable structure
are from 200 square feet to 300 square feet and would exempt setback and
frontage requirements of the zone they were located in, provided that the
structure be screened from the public or private street, unless in the judgment of
the Code Enforcement Officer/designee such screening would negatively impact
the public’s health, safety, or welfare. Also, provide exemption from Planning
Board approval, but meet all applicable building code requirements to include
permitting. Jim provided a visual illustration for the Committee members of the
Perry Road Pump Station and noted the yellow lines represented the street right-
of-way, shaded areas was the pavement, dashes were easements secured for
the pump station, green highlights represented the majority of the pump station
which was underground. Also noted on the illustration in orange were the
additions. Councilor Wheeler moved and seconded by Councilor Blanchette to go
to full Council with no objections.
